Terms of Contract and Payment Transaction with AV Fresh Farms

First, offers would be displayed on the company's website and prospect client would accept the offer by contacting AV Fresh Farms. Subsequent payment would be to AV Fresh Farms so items to be delivered subsequently.
AV Fresh Farms would only transact with client who are twenty-one years (21)years and above. AV Fresh Farms would not be held liable for a minor who contact with the company. This is a clause as part of contracting terms.
All cash transactions have to include money transfer charges as AV Fresh Farms admin is not responsible for payment of money transfer charges for business dealings on the website among sellers and buyers. Accepted Payment Methods (Mobile Money). Currency of payment, all payments shall be made in Ghanaian Cedis (GHS) unless otherwise agreed upon in writing.

Seller is to deposit cost of delivery (outbound and possible inbound costs) with AV Fresh Farms official account before dispatch of the goods to the customer. This is to cater for the entire dispatch costs both outbound and inbound in the case of bad goods sent to the customer that needs to be returned. These costs will be incurred by the seller as they are duty bound to send goods in good condition. Customers are not liable to pay dispatch of goods (both inbound and outbound costs) in bad state to the farmer or seller. In this instance a contract would be deemed to be form when there is offer, acceptance, consideration and the individual have the capacity to contract.
The said amount is refundable to the seller after order is complete without customer complaints about the produce or product less the money transfer charges. This would amount to consideration as a contract of formation between the seller and buyer. Buyer is to pay delivery costs for the produce or product. This will not be borne by the seller. For the contract to be discharged the items must be delivered to the buyer.
Request for refund of cash deposited in AV Fresh Farm's admin account, held in trust will normally take about twelve (12) hours to complete as AV Fresh Farms admin will manually review all requests in relation to the consensus with both parties to a selling and buying transaction. Sellers are duty bound to ensure the customer receives his/her produce or product at the estimated date as promised by the seller.
Unless there are occurrences beyond the sellers control in which case delivery delays, the seller is not liable for late deliveries. However, late deliveries should be made within reasonable time with the consent of the buyer. All monies paid by customers will be held in trust until goods are delivered and in good condition before the money paid is remitted to the seller.
All members are duty bound to cross check the official AV Fresh Farms Admin account details thoroughly before all cash deposits are made. AV Fresh Farms will not be liable for losses through inadvertent cash transfers to a different account from that which is provided on the Company's official website (www.avfreshfarmsmarket.com). In this case, senders of cash are responsible for liaising with the appropriate telecommunication service provider to retrieve their cash. AV Fresh Farms will not be responsible for that.
The contract would be deemed to have been properly discharged by agreement is the buyer agrees that what they requested for is what actually they have received. The delivery of the goods by the farmer would be considered the performance of the contract.
Instances where a buyer took a decision after the goods have reached their end without early cancellation, it would be deemed to be anticipatory breach on the side of the buyer. The buyer would have to pay for damages for the breach of a legally formed contract. In case where by the seller did not deliver the goods and the buyer also cancelled early in the contract, the would have been discharged by frustration. Remedies for breach of contract would be available to the seller and buyer.
All transactions on the AV Fresh Farms platform must be conducted through our secure escrow system. Direct payments to farmers, service providers, or equipment dealers are strictly prohibited and violate these terms and conditions. AV Fresh Farms acts as an intermediary to protect both buyers and sellers from fraudulent activities.
